Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your use of EchoGreek (the "App"), operated by Butler 616 LLC ("EchoGreek," "we," "us"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.

2. What EchoGreek is

EchoGreek is, right now, a single-campus pilot for Tulane University — an iPhone app for verified Tulane students to discover and coordinate fraternity and sorority events. It is not a general-audience social network, and these Terms are written with that scope in mind. If EchoGreek expands to other schools or platforms in the future, we'll update these Terms accordingly.

EchoGreek is an independent app. We are not affiliated with, endorsed by, or sponsored by Tulane University, and we are not affiliated with any national fraternity or sorority organization. Chapter names and Greek letters appear in the App to identify campus organizations, not to claim any connection with them.

You retain ownership of the content you post — your profile information, your bio, your photos, and any messages you send. By posting content, you grant EchoGreek a non-exclusive, royalty-free license to host, store, and display that content as needed to operate the App — meaning we show it only to the people your visibility settings and the App's rules allow to see it (for example, showing your profile photo to other students on your campus, or showing a party's poster to people who can see that event). This license ends when you delete the content or your account, except that copies may persist briefly in backups.

Chapter chairs who post events and upload event/party photos are responsible for having the right to post that content and for it being accurate and appropriate. Don't post photos of people who haven't agreed to appear in them.

6. The nudge feature — how it actually works

Nudges and date invitations are EchoGreek’s two messaging features, and both are deliberately bounded, not open chat systems. A date invitation is a single message inviting one person to be your date at your chapter’s event, which they accept or decline; both people must be 18 or older. Nudges work as follows:

7. Prohibited conduct

EchoGreek has zero tolerance for objectionable content and abusive behavior. When using EchoGreek, you agree not to:

8. Reporting, blocking, and enforcement

EchoGreek gives you tools to block another user (which removes them from your view and you from theirs across the app — their profile, RSVP lists, the date board, and reminders — and prevents any new nudge between you, though it doesn't erase a nudge exchange that already happened before the block) and to report a user, an event, or a message for review.

We act on reports of objectionable content within 24 hours — removing content that violates these Terms and, where warranted, ejecting the user responsible. See our Privacy Policy for more detail on how reporting and blocking work today.

9. Chapter chairs

If you're a chapter chair, you have additional capabilities — posting events, uploading photos, managing your chapter's join code and roster — and additional responsibility for using them appropriately: only post events and photos you have the right to post, and only for your own chapter.

10. Termination

You may stop using EchoGreek and delete your account at any time. We may remove content, or suspend or terminate your account, if you violate these Terms, including the prohibited conduct in Section 7. Sections 5 (as to the wind-down of licenses), 11, 12, 13, 14, and 15 survive any termination.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be uninterrupted, error-free, or secure, or that information in it (including event details and headcounts) is accurate or complete.

EchoGreek is a discovery and coordination tool. We do not organize, host, sponsor, supervise, or control any event listed in the App. Events are posted by chapter chairs, not by us; we do not inspect venues, verify event details, or vet attendees. If you attend an event you found on EchoGreek, you do so at your own risk. Your interactions with other users — in the App, over a nudge, on other platforms, or in person — are your own responsibility, and we are not responsible for the conduct of any user, online or offline.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Butler 616 LLC and its members, managers, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or personal injury arising from events or user interactions — arising out of or relating to the App or these Terms, even if we've been advised such damages are possible.

Our total aggregate liability for all claims relating to the App or these Terms will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the claim arose. (EchoGreek is currently free, so for most users that means $100.)

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you. In those jurisdictions, our liability is limited to the fullest extent the law allows.

13. Indemnification

You agree to indemnify and hold harmless Butler 616 LLC and its members, managers, officers, and agents from claims, damages, and reasonable expenses (including attorneys' fees) arising out of your content, your use of the App, your conduct at or in connection with any event, or your violation of these Terms or of any law or third-party right.

14. Governing law

These Terms, and any dispute arising out of them or the App, are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Florida will have exclusive jurisdiction over any such dispute, and each of us consents to venue and personal jurisdiction there. Nothing in this section limits any non-waivable rights you may have under the consumer-protection laws of the place where you live.

15. General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us about the App. Our not enforcing a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

16. Changes to these Terms

If we make a material change to these Terms, we'll update the date at the top and make a reasonable effort to let users know before the change takes effect. Continuing to use the App after a change takes effect means you accept the updated Terms.
